Terms of Service

Plain-English summary. Arbel is a free, browser-based website builder. You agree to use it lawfully, you keep ownership of websites you create, but the Arbel platform itself, its source code, design, brand, templates, generators, AI prompts, and underlying technology, are exclusively owned by Arbel Live Technologies. Copying, cloning, mirroring, rehosting, reverse-engineering, or rebranding the Arbel platform is strictly prohibited and will be enforced through copyright, computer-misuse, trademark, and unfair-competition laws worldwide. The Service is provided as-is with no warranty and to the maximum extent permitted by law our liability is capped at zero.
These Terms of Service ("Terms") form a legally binding agreement between you ("you," "User") and Arbel Live Technologies ("Arbel," "we," "us," "our") governing your access to and use of the Arbel website, web application, generator, builder, deployment tooling, APIs, administrative endpoints, marketing pages, demo sites, marketplace assets, and any related services (collectively, the "Service") at arbel.live, arbeltechnologies.github.io, any sub-domain, mirror, or successor URL.
By accessing, browsing, registering with, or otherwise using the Service in any way, you acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms and by the Privacy Policy. If you do not agree, you must not use the Service.
1. Definitions
- "Platform" — the Arbel software, including its source code (HTML, CSS, JavaScript, Worker code), design system, templates, scenes, marketplace kits, prompts, AI orchestration logic, the Cinematic and Classic generators, the deploy pipeline, the admin dashboard, all documentation, and the brand "Arbel."
- "User Content" — the websites, copy, images, code, prompts, and assets you create or supply when using the Service.
- "Generated Output" — the static-site files (HTML/CSS/JS) the Service emits to your GitHub repository when you click Deploy.
- "AI Output" — text, images, code, or other media returned by an integrated AI provider (Groq, Google Gemini, etc.) in response to your prompts.
- "Restricted Feature" — any feature marked beta, preview, coming-soon, or internal-only, including but not limited to Cinematic Mode.
2. Eligibility
You represent and warrant that you (i) are at least 16 years of age (or the older age of majority in your jurisdiction); (ii) have the legal capacity to enter a binding contract; (iii) are not a person barred from receiving services under the laws of India, the United States, the European Union, the United Kingdom, or any other applicable jurisdiction; and (iv) are not located in, organised under, or a national of any country subject to comprehensive trade sanctions by such authorities. If you are using the Service on behalf of an organisation, you further warrant that you have authority to bind that organisation, and references to "you" include both you and the organisation.
3. Description of Service
Arbel is a client-side website generator. The Service runs almost entirely in your browser; deployment is performed by your own GitHub account. Arbel offers free use at the levels currently published. Features, limits, templates, and AI integrations may change at any time.
4. Authentication
- You authenticate with the Service using your own GitHub account, OAuth flow, or Personal Access Token. Arbel does not maintain user accounts on its servers.
- You are solely responsible for the confidentiality and proper use of your GitHub credentials, OAuth tokens, AI provider API keys, and any other secrets you enter into the Service.
- You must use fine-grained, minimum-scope tokens wherever your provider supports them and revoke any token you suspect has been compromised.
- Arbel never sees, requests, or stores your AI provider API keys; they remain in your browser.
5. Ownership of Your Content
- You retain all right, title, and interest in and to your User Content and the Generated Output that ends up in your GitHub repository.
- You grant Arbel a non-exclusive, royalty-free, worldwide licence solely to process User Content as needed to operate the Service for you (e.g., compiling templates with your inputs and writing the result to your GitHub repository). This licence terminates the moment you close the browser tab.
- You are solely responsible for ensuring that your User Content and any Generated Output you publish does not violate any law or any third party’s intellectual-property, privacy, publicity, defamation, or other rights.
6. Ownership of the Arbel Platform
- The Platform, including all source files, build pipelines, design tokens, brand assets, copywriting, generator logic, AI prompts and prompt structures, scene definitions, marketplace kits, Worker code, admin tooling, and the name "Arbel" together with related logos and trade dress, is and remains the exclusive intellectual property of Arbel Live Technologies and is protected by copyright, trade-secret, trademark, database-right, and unfair-competition laws of India and every country that recognises analogous protection through international treaties (including the Berne Convention, TRIPS, and the WIPO Copyright Treaty).
- Nothing in these Terms transfers any ownership of the Platform to you. Your use of the Service grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to access the Service in unmodified form solely for the purpose of generating your own websites in accordance with these Terms. No other right or licence, express or implied, is granted.
- All client-side source code served to your browser remains protected proprietary work even though it is technically necessary for the browser to receive it. Receipt by your browser does not constitute publication into the public domain, dedication of any copyright, or grant of any further right.
7. Anti-Clone, Anti-Mirror & Reverse-Engineering Prohibition
You shall not, and shall not permit or assist any other person to, do any of the following with respect to the Platform, in whole or in part, whether by automated means, manual means, or AI-assisted means:
- copy, reproduce, mirror, archive, scrape, fork, rehost, redistribute, sublicense, sell, lease, lend, or otherwise commercialise the Platform or any part of it;
- create a competing or substitutable product or service that is derived from, substantially similar to, or intended to replicate the Platform’s look, feel, behaviour, generator logic, scene system, prompt structures, or unique combinations of features;
- remove, hide, alter, or fail to reproduce any copyright, trademark, attribution, or proprietary notice;
- reverse-engineer, disassemble, decompile, decrypt, decode, translate, or otherwise attempt to derive the source code, ideas, algorithms, or know-how of any non-published portion of the Platform (including Worker code), except to the limited extent that this prohibition is unenforceable under mandatory applicable law (e.g., for interoperability under the EU Software Directive, in which case you must first request the necessary information in writing from Arbel);
- use the Platform or its outputs to train, fine-tune, evaluate, benchmark, or improve any machine-learning or generative-AI model;
- use any robot, spider, scraper, or automated means to access, copy, or index the Platform other than well-behaved search-engine crawlers acting in compliance with our
robots.txt; or
- circumvent, disable, or interfere with security, rate-limit, origin-allow-list, CSP, authentication, admin, or content-protection features of the Platform.
Each of the above is a material breach of these Terms and may also be a separate violation of copyright, computer-misuse (e.g., the US Computer Fraud and Abuse Act, the UK Computer Misuse Act 1990, India’s Information Technology Act 2000), trade-secret, and unfair-competition laws. Arbel reserves all rights and remedies, including injunctive relief, statutory damages, account-of-profits, and recovery of legal costs.
8. Acceptable Use Policy
You agree that you shall not use the Service to:
- publish, host, or distribute content that is unlawful, threatening, defamatory, obscene, sexually explicit involving minors, hateful, harassing, fraudulent, deceptive, or that incites violence or terrorism;
- publish, host, or distribute malware, ransomware, phishing pages, scams, fake-storefronts, cryptojacking scripts, or any tool intended to facilitate unauthorised access to computers, accounts, or data;
- impersonate any person, organisation, government, or brand, or misrepresent your affiliation with any of the foregoing;
- infringe any patent, copyright, trademark, trade secret, right of publicity, right of privacy, moral right, or other intellectual property right;
- violate any applicable law or regulation in any jurisdiction in which the website is accessible;
- attempt to gain unauthorised access to, probe, scan, stress-test, or interfere with the Service, our infrastructure, our sub-processors’ infrastructure, or any other user’s account or content;
- use, attempt to use, share, or distribute the dev-unlock parameter, internal feature flags, admin tokens, or any other mechanism gating Restricted Features (see §11);
- collect, harvest, or process personal data of others through the Service without a lawful basis;
- use the Service in a manner intended to disparage Arbel or its Platform.
Arbel may, but is not obliged to, monitor compliance and may terminate access without notice for violations.
9. Third-Party Services
- The Service depends on third-party services including GitHub (deployment), Cloudflare (Workers and CDN), Google Fonts (typography), and optional AI providers Groq and Google Gemini. Your use of those services is governed by their own terms of service and privacy policies. Arbel is not responsible for the availability, accuracy, content, security, or business practices of any third party.
- If a third-party service changes, becomes paid, deprecates an API, or terminates, the corresponding Arbel feature may change or stop working without notice and without liability to you.
10. AI Features & Outputs
- AI Outputs are produced by third-party providers based on inputs you supply and are not reviewed, curated, edited, fact-checked, or approved by Arbel.
- AI Outputs may be inaccurate, biased, hallucinated, offensive, derivative of training data, or infringing. They are not legal, medical, financial, accounting, tax, engineering, or other professional advice.
- You assume full responsibility for evaluating AI Outputs before publication and for ensuring you hold the necessary rights to use any image, name, likeness, brand, or copyrighted text contained in or generated through the Service.
- Arbel makes no warranty that AI Outputs are original, non-infringing, or fit for any particular purpose, and disclaims all liability arising from your reliance on or publication of AI Outputs.
11. Beta, Preview & Restricted Features
- Some features may be offered as beta, preview, experimental, internal-only, or "Coming Soon." These are provided strictly on an "as-is" basis with no service-level commitments and may be changed, throttled, or removed at any time without notice.
- Restricted Features may be enabled only by mechanisms designated by Arbel for authorised personnel. Any attempt by an unauthorised person to enable, access, share, or use a Restricted Feature — including by guessing, social-engineering, sharing, distributing, or extracting an unlock parameter — is a material breach of these Terms and may constitute unauthorised access under applicable computer-misuse laws.
- Beta and Restricted Features are excluded from any warranty, indemnity, or remedy under these Terms.
12. Security & Tokens
- You shall not attempt to bypass security controls, rate limits, origin restrictions, CSP headers, authentication tokens, brute-force lock-outs, or admin gating mechanisms.
- You shall not test, probe, or audit the Service’s security without our prior written authorisation, except for good-faith vulnerability discovery reported responsibly to
arbeltechnologies@gmail.com with subject [SECURITY] and not exploited beyond the minimum necessary to demonstrate the issue.
- We do not currently offer a paid bug-bounty programme. Coordinated disclosure is appreciated and will be credited where you wish.
13. Analytics & Telemetry
By using the Service you acknowledge that we collect the limited, anonymous, non-identifying usage metrics described in our Privacy Policy § 4. These metrics are technically necessary to operate the Service responsibly. You may opt out as described in Privacy Policy § 17.
14. Fees & Tax
The Service is currently provided free of charge. Arbel may introduce paid plans, add-ons, or transactional fees in the future and will give reasonable advance notice. You are solely responsible for any taxes, duties, levies, or fees imposed by your jurisdiction in connection with websites you publish, revenue you generate from those websites, or services you procure from third parties (including GitHub Pages, Cloudflare, AI providers).
15. Disclaimer of Warranties
The Service, the Platform, all generated output, all AI output, all templates, all marketplace assets, and any other materials are provided "as is" and "as available," with all faults, and without any warranty of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by applicable law, Arbel expressly disclaims all warranties, including the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, title, quiet enjoyment, non-infringement, security, uninterrupted or error-free operation, and any warranty arising from course of dealing or usage of trade.
- Arbel does not warrant that the Service will meet your requirements, be available at any particular time or location, be free of viruses or other harmful components, or that any defects will be corrected.
- Arbel does not warrant that Generated Output or AI Output will function correctly on any browser, device, hosting environment, or that deployment to GitHub Pages will succeed in any particular case.
- Arbel makes no representation regarding website performance, search-engine rankings, conversion rates, or business outcomes you may achieve through the Service.
- You bear all risk arising from your use of the Service. No advice or information obtained from Arbel creates any warranty not expressly stated in these Terms.
16. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Arbel Live Technologies, its successors, affiliates, founders, directors, officers, employees, contributors, agents, or licensors be liable to you or any third party for any:
- indirect, incidental, special, consequential, exemplary, or punitive damages;
- loss of profits, revenue, goodwill, business opportunity, customers, contracts, anticipated savings, data, content, reputation, or use;
- cost of substitute goods or services;
- damages arising out of unauthorised access to or alteration of your data, content, tokens, keys, or websites;
- damages arising from third-party services (including GitHub, Cloudflare, AI providers) or AI Output;
- damages arising from deployment failures, downtime, content loss, or any other matter relating to the Service;
regardless of the legal or equitable theory (contract, tort, negligence, strict liability, statute, restitution, or otherwise), even if Arbel has been advised of the possibility of such damages and even if a remedy fails of its essential purpose.
Aggregate liability cap. The total cumulative liability of Arbel and all persons listed above to you for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the total amounts you have paid Arbel for the Service in the twelve months immediately preceding the event giving rise to the claim, which in the case of a free Service is USD 100 (one hundred United States dollars), and (b) the minimum amount mandatorily required by applicable law.
Mandatory exclusions. Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by Arbel’s gross negligence, or any other liability that cannot be excluded under applicable law (including, in the EU/UK, statutory consumer rights).
17. Indemnification
You shall defend, indemnify, and hold harmless Arbel, its successors, affiliates, founders, directors, officers, employees, contributors, agents, and licensors from and against any and all claims, demands, suits, proceedings, damages, losses, liabilities, settlements, judgments, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or relating to:
- your access to or use of the Service;
- your User Content, your Generated Output, or your publication of any AI Output;
- your violation of these Terms, the Privacy Policy, or any applicable law;
- your violation of any third-party right, including any intellectual-property, privacy, publicity, or contract right;
- any dispute between you and a third party arising out of your use of the Service;
- your use of third-party services, tokens, API keys, or credentials in connection with the Service;
- any claim that the websites you publish through the Service caused harm to a third party.
Arbel may, at its option, assume the exclusive defence and control of any matter for which you are required to indemnify us, in which case you shall cooperate fully at your expense.
18. Suspension & Termination
- Arbel may, at its sole discretion and without prior notice, suspend, restrict, throttle, or terminate your access to the Service in whole or in part for any reason, including any actual or suspected violation of these Terms.
- You may stop using the Service at any time. To delete browser-local data, clear site data for
arbel.live.
- Upon termination, your right to access the Service ceases immediately. Websites you have already deployed to your own GitHub repositories are not affected and remain solely under your control.
- Sections 1, 5, 6, 7, 10, 12, 14–31 survive termination.
19. DMCA & Takedown
Arbel respects the intellectual-property rights of others and expects users to do the same. If you believe content generated, hosted, or published with the assistance of the Service infringes a copyright you own or control, send a written notice in compliance with 17 U.S.C. § 512(c)(3) to arbeltechnologies@gmail.com with subject [DMCA], including:
- your physical or electronic signature;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material that is claimed to be infringing and information sufficient to allow us to locate it (URL preferred);
- your contact information (name, postal address, telephone, email);
- a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law;
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorised to act on behalf of the copyright owner.
Equivalent notice procedures apply for trademark, defamation, and other content claims. We will respond as required by applicable law and may forward your notice to the affected party. Submitting a knowingly false notice may expose you to liability under 17 U.S.C. § 512(f) or analogous laws.
20. Trademark Policy
"Arbel," the Arbel logo, and any related word marks, design marks, or trade dress are trademarks of Arbel Live Technologies. You shall not use any of them in a manner likely to cause confusion, dilute their distinctiveness, suggest endorsement, or in any way that is disparaging or detrimental. All other trademarks referenced in the Service are the property of their respective owners and are used for nominative or descriptive purposes only.
21. Export Controls & Sanctions
You represent and warrant that you (i) are not located in, organised under the laws of, ordinarily resident in, or a national of any country or territory subject to comprehensive trade sanctions by the United Nations, the United States, the European Union, the United Kingdom, or India; (ii) are not on any restricted-party list maintained by any of the foregoing (e.g., OFAC SDN, EU Consolidated List, UK HMT List); and (iii) shall not use the Service to design, develop, produce, or use any weapon, including any nuclear, chemical, biological, missile, or unmanned-aerial system, or in any other way that violates applicable export-control or sanctions laws.
22. Changes to the Terms
Arbel may amend these Terms from time to time. The current version is always posted at this URL with an updated "Last Updated" date and a version number. Material changes that meaningfully reduce your rights or expand your obligations will be highlighted in a banner on the Generator for at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to a change, your sole remedy is to stop using the Service.
23. Governing Law & Venue
These Terms, the Privacy Policy, and any non-contractual obligations arising out of or relating to them or to the Service are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles. Subject to §24, the competent courts in Bengaluru, Karnataka, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in this clause affects mandatory consumer-protection rights you may have in your country of habitual residence.
24. Dispute Resolution & Arbitration
- Informal resolution. Before filing any claim, you agree to first contact Arbel at
arbeltechnologies@gmail.com with subject [DISPUTE], describing the dispute and the relief you seek, and to negotiate in good faith for at least 60 days.
- Binding arbitration. If the dispute is not resolved informally, it shall be finally settled by binding arbitration administered under the Arbitration and Conciliation Act, 1996 of India, by a sole arbitrator appointed in accordance with the rules of the Mumbai Centre for International Arbitration (MCIA). The seat and venue shall be Bengaluru, India; the language English. Each party bears its own costs except as the arbitrator orders otherwise. The award shall be final and enforceable in any court of competent jurisdiction worldwide under the New York Convention 1958.
- Carve-outs. Either party may seek (a) interim or injunctive relief in any court of competent jurisdiction to protect its intellectual-property rights and (b) small-claims relief for individual claims that qualify, where available.
25. Class-Action & Jury-Trial Waiver
To the maximum extent permitted by law, you and Arbel each waive any right to a jury trial and any right to participate as a plaintiff or class member in any class action, collective action, mass action, private attorney-general action, or representative proceeding against the other in any forum. Disputes shall be resolved on an individual basis only.
26. Force Majeure
Arbel shall not be liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil disorder, government action, sanctions, embargoes, epidemics, pandemics, internet or telecommunications failures, power outages, denial-of-service attacks, vendor failures (including those of Cloudflare, GitHub, Google, or Groq), or strikes.
27. Notices
Notices to Arbel must be in English and sent to arbeltechnologies@gmail.com with the appropriate subject prefix. Arbel may give you notice by posting on the Service, by in-product banner, or by sending email to any address associated with your authenticated session.
28. Assignment & Succession
You may not assign, sublicense, or otherwise transfer any of your rights or obligations under these Terms without Arbel’s prior written consent. Any purported assignment in breach of this clause is void. Arbel may freely assign or transfer these Terms in connection with a merger, acquisition, corporate reorganisation, or sale of substantially all assets, in which case the Terms continue to bind the successor.
29. Severability & Reformation
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties’ original intent, and the remaining provisions shall continue in full force and effect.
30. Entire Agreement & Survival
These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and Arbel concerning the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written. Failure of Arbel to enforce any right or provision is not a waiver of that right or provision. Headings are for convenience only and have no legal effect.
